1. Separate Car Seat Hire Service

The €10 charge relates specifically to the hire and provision of the baby/child car seat requested by the customer.

The car seat hire is an additional service requested by the customer and is separate from the taxi transportation service and the taxi fare.

The taxi fare itself remains subject to the applicable Irish taxi fare regulations and is calculated separately. Nothing in these Terms is intended to alter, increase or replace the regulated taxi fare, including any applicable statutory booking fee or other permitted taxi charge.

2. Agreement to the €10 Car Seat Hire Charge

By requesting a taxi booking with a baby or child car seat, you expressly agree to the €10 car seat hire charge for that taxi journey.

The charge will be disclosed to you before your booking is confirmed. If you do not agree to the €10 car seat hire charge, you should not request the car seat hire service.

3. Reason for the Car Seat Hire Charge

A baby or child car seat is not ordinarily carried as part of the taxi vehicle's standard equipment.

When a customer requests a car seat, additional operational arrangements may be required to make the equipment available for the journey.

This may require the driver or another member of our operation to:

• Leave their normal place of work or operating location;
• Travel to our designated depot or storage location to collect the appropriate car seat;
• Spend additional time collecting, preparing and making the car seat available for the booked journey;
• Return to the depot or designated storage location after the journey to return the car seat; and
• Spend additional working time and incur associated operational costs in managing, storing and maintaining the equipment.

The €10 charge is intended to cover the provision and hire of the car seat and the associated operational costs of making that equipment available to the customer.

4. The Charge Is Per Taxi Journey

The €10 car seat hire charge applies per taxi journey for which a car seat is requested and provided.

For example, where a customer books a taxi journey with a car seat for an outward journey and separately books another journey requiring the car seat to be provided again, the €10 charge may apply to each journey.

5. Car Seat Availability

Car seats are subject to availability and must be requested in advance.

A request for a particular type of car seat does not guarantee availability unless the booking has been expressly confirmed by us.

Where we cannot provide the requested car seat, we will notify you as soon as reasonably practicable.

We reserve the right to decline a car seat request where we reasonably believe that the available equipment is unsuitable for the child or cannot be safely provided for the vehicle or journey concerned.

6. Information About the Child

When requesting a car seat, the customer must provide accurate information reasonably required to determine whether the available seat is appropriate, including, where requested:

• The child's age;
• The child's height;
• The child's weight; and
• Any other relevant information concerning the child's size or requirements.

The customer must notify us if any information supplied changes before the journey.

We cannot guarantee that a car seat will be suitable where the customer has provided inaccurate, incomplete or misleading information.

7. Suitability and Safety

Car seats are provided as equipment for use during the booked journey and should be used in accordance with the manufacturer's instructions and applicable safety requirements.

The customer is responsible for providing accurate information about the child so that an appropriate seat can be selected where available.

Where appropriate, the driver may provide reasonable assistance with positioning or fitting the seat. However, the customer remains responsible for checking that the child is properly positioned and secured in accordance with the seat manufacturer's instructions.

A rearward-facing child car seat must not be used in a front passenger position where there is an active frontal airbag.

If the driver reasonably considers that the requested car seat cannot be safely installed or used in the vehicle, the driver may refuse to use the seat or may decline to carry the passenger with the requested car seat.

8. Customer's Responsibility

Parents, guardians or accompanying adults remain responsible for ensuring that the child is properly secured and that the car seat selected is suitable for the child.

Customers should satisfy themselves that the available car seat meets their own requirements before travelling.

The provision of a car seat by us does not constitute professional child-safety, medical or technical advice.

9. Car Seat Condition and Use

The car seat remains the property of SuirGo Taxi Waterford or its relevant owner and is provided to the customer solely for use during the booked journey.

The customer must not:

• Remove the car seat from the taxi;
• Alter, modify or dismantle the car seat;
• Interfere with its safety mechanisms;
• Use the car seat for any purpose other than transporting the child during the booked journey; or
• Permit another person to remove or retain the car seat.

The customer must notify us immediately if the car seat is damaged, becomes soiled, or appears to have been involved in an incident that could affect its safety.

10. Damage, Loss or Misuse

The customer may be responsible for reasonable costs arising from loss of, deliberate damage to, misuse of or unauthorised retention of the car seat.

Any such claim will be considered separately from the €10 hire charge and will be based on the actual circumstances and applicable law.

11. Cancellation

If a booking including a car seat is cancelled, the treatment of the €10 car seat hire charge will depend on when the cancellation occurs and whether the car seat has already been collected, prepared or otherwise allocated for the booking.

Any applicable cancellation terms will be communicated to the customer at the time of booking.

Where the car seat has not been provided and the booking is cancelled within the applicable cancellation period, the car seat hire charge may be refunded where appropriate.

12. No Guarantee Where Circumstances Prevent Safe Use

We will make reasonable efforts to provide the requested car seat where it has been booked in advance.

However, we cannot guarantee that the car seat can be used in every circumstance. This may include circumstances involving vehicle configuration, incompatibility, safety concerns, damage to equipment, incorrect information supplied by the customer, or other circumstances outside our reasonable control.

Where the car seat cannot safely be provided or used, we will explain the circumstances to the customer and, where appropriate, address any refund due for the car seat hire in accordance with our cancellation/refund policy.

13. Taxi Fare Remains Separate

The customer acknowledges that the €10 car seat hire charge does not replace or alter the taxi fare.

The taxi journey will remain subject to the applicable taxi fare regulations, including the applicable metered fare and any legally permitted charges.

Any statutory taxi booking fee applicable to a pre-booked taxi is separate from the €10 car seat hire charge.

14. Acceptance of These Terms

By requesting a baby/child car seat when making a booking, the customer confirms that:

• They have been informed of the €10 car seat hire charge;
• They understand that the charge relates to the provision and hire of the car seat;
• They understand that the taxi fare is calculated separately;
• They agree to pay the €10 car seat hire charge for the relevant journey; and
• They accept these Car Seat Terms and Conditions.

15. Changes to These Terms

We may amend these Car Seat Terms from time to time. The version applicable to your booking will be the version presented to you when you make or confirm your booking.

16. Governing Law

These Car Seat Terms are governed by the laws of Ireland.

Nothing in these Terms is intended to exclude, restrict or limit any statutory rights or protections available to consumers under Irish or European Union law.

Where any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision shall be severed or modified to the minimum extent necessary, and the remaining provisions shall continue in effect.
